PRACTICE UPDATE: How the content must now be read in light of current ImmD policy:

Historically, this installment in the DIY Visa Guide served as the core factsheet and structural briefing for self-represented applicants, condensing the procedural lifecycle, statutory criteria, and operational expectations of an Investment as Entrepreneur visa under the General Employment Policy (GEP). The Geeza structured this guide as an accessible, high-level roadmap designed to demystify ImmD’s internal assessment: demystifying the “substantial contribution to the economy of the HKSAR” test, mapping out realistic processing timeframes, and reassuring unassisted founders that their cases were judged on overall commercial merit rather than institutional pedigree. Under that era’s discretionary standard, the factsheet gave founders immense confidence: an applicant could comfortably launch an independent venture by deploying modest personal capital of a few hundred thousand dollars, securing a flexible serviced office or shared co-working membership, and presenting a business plan committed to gradual local headcount growth over a two- to three-year horizon.

The game has changed from an accessible procedural briefing into a completely obsolete relic of an extinct discretionary regime. Today, relying on this historical factsheet gives an applicant an entirely false sense of security that leads directly to an administrative wall. Under post-April 2026 administrative practice aligned with TTPS Category A operational substance (~HKD 2.5M enterprise scale), the statutory “substantial contribution” test is no longer an open-ended, holistic evaluation of commercial viability or founder potential. For un-incubated applicants, ImmD has eliminated qualitative discretion and phased narrative timelines, replacing them with a rigid, binary compliance audit requiring non-negotiable corporate hardware verified on day one: HKD 1.5M–2.0M in deployed corporate bank liquidity sitting in a local bank account, an executed commercial lease for exclusive physical premises (“four walls”) that strictly disqualifies serviced offices, virtual addresses, and co-working desks entirely, and active Mandatory Provident Fund (MPF) payroll contributions for 2–3 local Hong Kong permanent residents.

Consequently, the core takeaway of this factsheet has been fundamentally inverted: unassisted, lean bootstrapping outside official state pipelines is no longer legally viable. An independent entrepreneur who reads this historical overview and submits an application matching its parameters will face swift and summary refusal, terminating lawful stay and permanently severing their continuous ordinary residence path toward Right of Abode. The modern business entry framework leaves only one lawful bypass for seed-stage, lean founders: formal, documented admission into an officially accredited government incubator (such as Cyberport, HKSTP, or the Design Incubation Programme)—which serves as the sole statutory safe harbor waiving the upfront liquidity, dedicated commercial lease, and immediate MPF headcount thresholds. Outside this accredited institutional safe harbor, the factsheet’s historical baseline of accessible, self-directed entrepreneurship has ceased to exist.
