What Visa Options Exist For A Trailing Girlfriend Where There is No Possibility of a Hong Kong Defacto Spouse Visa?

QUESTION

I have looked over your website and found lots of good information.

However, I think I have a question that may not have been answered on the site.

I have been offered a job in Hong Kong and want to accept it and move there with my girlfriend.

She is from Turkey and is 30 years old.

I don’t think we will be able to apply for a Hong Kong defacto spouse visa as we have not lived together for long enough etc.

My question is: Do we basically need to get married?

Or is another option repeated visa runs on her part?

QUESTION

I am an American who has recently married a Filipina.  

I do not have any residence visa for Hong Kong; I’m just here as a 90 day visitor as a US citizen.

Can I get relative visa for my wife for the same 90 day stay?

I can document our relationship (her passport now has my last name) and support.

We are staying in a hotel for her allowed 2 weeks. In this case is a lease proving roof over head advisable?

I am certified to teach with a Masters degree.

Long term, I will be seeking out desirable employment and feasibility of permanent residence.

Do You Need to Have Been Physically Present in Hong Kong for a Full Seven Years (i.e 2555 Days All Told) in Order to Qualify for Hong Kong Permanent Residency?

Sometimes even the big name publications can get their facts (and law) wrong… do you need to have been physically present in Hong Kong for a full seven years (i.e 2555 days all told) in order to qualify for Hong Kong permanent residency?

Dear Stephen,

The Wall Street Journal guide to HK states (here: http://guides.wsj.com/hong-kong/guide-to-hong-kong/visas-and-residency/ ), concerning the application for the right of abode, that “foreign nationals need to have stayed in Hong Kong for a continuous seven years.

If one traveled for a month outside Hong Kong within a seven-year period, then he or she needs to have resided in Hong Kong for at least seven years and one month.”

Is that last sentence accurate?

A related question:

In some sources, I have read that any continuous absences from Hong Kong of over 6 months need to be listed (and explained) in the application.

Some sources say that whenever one is absent more than 6 months within a year (whether continuous or not), this has to be listed (and explained).

Could you clarify?

Do You Need a Visa to Operate a Business in Hong Kong if You Are Not Yet Resident Here?

Great question today with a simple answer and an opportunity to shed some more light on the Catch 22 and  your ‘intention to reside’…SMALL-keep-calm-and-ask-the-visa-geeza

QUESTION

Who we are: We are a UK pharmaceutical wholesale distributor in business for 15 years, currently selling into Hong Kong. 

Objective: To establish an office and register 3 pharmaceutical products with the Department of Health  for distribution in Hong Kong, and eventually, other Asian countries.

Current plan: The registration process takes 12-18 months, and during that time, we intend to establish a virtual office (assigning a local representative), until the time approaches when the product registration has been completed and approved. We will also have the support from a local pharmaceutical wholesale distributor for the registration process. 

Our business plan would eventually add local jobs, and would fully rely on local vendors.  As a matter of fact, we are looking into the possibility of handling all imports, after successful registration, through local vendors/distributors to avoid the overhead of a receiving facility for a while, using Hong Kong as a jurisdiction/launching pad, until sales build up enough to open our own receiving center. 

Upon the time that it becomes essential for us to personally oversee the Hong Kong business, we (UK nationals) would relocate there, and of course establish a permanent office space.

Question: It seems like passing the business investment approvability test should be at the forefront of our business plans in order to conscientiously “build our case”.  You mention that it’s best to have an application in the system from the onset (empower the HKID to take an early view), in order to protect yourself from the risk of prosecution. 

When you say from the onset, does that refer to the date when you incorporate your company, from the date that you launch your business in Hong Kong (actual sales), or from the date you intend on taking residence in Hong Kong? 

I am confused on this matter because it is my understanding that HKID frowns on applications for investment visas that are submitted after all is moving forward (Catch 22).

If the answer is from the date you incorporate your company, how do they expect your buisiness to show any strength or growth if you aren’t yet authorised to sell?

Does the strategy of a virtual office (running it from the UK with occasional visits to HK), establishing firm lines of business, and employing a few people to assist with sales and customer service, strengthen your application, or does that place you at risk for prosecution from the HKID?

You also mention the need to provide capital and living expenses at the time of application.  For how long is that money inaccessible?  Does the business plan, and current standing of your business determine the amount of the deposit they require?

Can You Work For a Single Client as a Pseudo-Employee Whilst Holding a Hong Kong Investment Visa?

If you are granted a Hong Kong investment visa, does this allow you to (essentially) take up a dedicated employment on a consulting basis for a single client, effectively taking up a full time role to the exclusion of all other business opportunities for your self-owned company?

QUESTION

Hi,

I’m currently in the process of applying for my Hong Kong investment visa.

In addition, I have an interview for a consulting position with another organization.

They will not support me with the visa and have asked me if I can also work with an investment visa.

The answer I got from immigration was that I cannot take up a full-time position when holding only an investment visa and that I also need to apply for a work visa.

I was wondering if there is any possibility or workaround?

The consulting position is related to my start-up, so I thought about asking the organization to contract my company as a consultant.

I would appreciate your advice on my case.
