Hong Kong Employment Visa for an Independant Contractor? The General Employment Policy anticipates that foreign national Professionals seeking to work in Hong Kong are subject to a formal employer-employee relationship. So what’s the situation if the employer wants to engage you as a contractor? Is it do-able?

Dear Stephen,

I got a working visa in Hong Kong associated with my current employer.

I received an offer in another business in Hong Kong but they said it’s a contractor job.

Can I Apply to Extend My Current Hong Kong Work Visa At the Same Time as I Apply for a Change of Employer?

Posted by / in Employment Visas, Your Question Answered / 2 responses

First Published April 5, 2016

I’ve been asked this question a lot these days so I’m republishing this earlier answer here…

How can you manage an impending Hong Kong work visa expiry challenge with a current employer with the prospect of a wholly new employment looming large?

SMALL-keep-calm-and-ask-the-visa-geeza

QUESTION

My first Hong Kong work visa issued under the General Employment Policy is going to expire on August 20th 2016, after one year of permission.

Recently I received a new job offer and I would like to know which is the best way to extend my Hong Kong work visa in your opinion:

  1. ) Online application and extension with the current employer
  2. ) Appointment at the immigration headquarter and extension with the new employer.

Since the new employer is flexible with the contract starting date, I would like to know if I can submit the application whilst still employed with my current employer.

On the other hand, do you think that changing my job immediately after getting my extension approved with my current employer might create some hassle?

Also how much in advance I can submit the application? I would like to submit the application by the end of April.

Thanks for your help

Is It Possible to Maintain My 6 Years’ Ordinary Residence In Hong Kong & Get the Right of Abode Next Year if I Plan to Move to Taiwan Soon?

Posted by / in Long Stay & PR, Your Question Answered / 2 responses

What happens if you get to 6 years continuous ordinary residence then plan to leave Hong Kong?

SMALL-keep-calm-and-ask-the-visa-geeza

QUESTION

Hello,

I am in Hong Kong since 6 years on an employment visa all throughout and am aiming for PR next year in July.

However, I am about to change job and the new company wants me to move to Taipei.

I have the flexibility to negotiate with them.

With an objective to be eligible to apply for the Right of Abode next year, what should I do? Please let me know.

Should I ask for a Hong Kong contract and that is enough and be transferred or do i need to be on Hong Kong contract and also maintain a rented apartment here?

I would want to get it done in simplest way without too much costs to me or to the employer.

Thank you for your advice in advance.

What Can I Do To Maintain My Eligibility for Right of Abode in Hong Kong Now That I’ve Been Made Redundant?

What happens to your prospects for permanent residency in Hong Kong if you’ve been made redundant but have no firm intention to rejoin the workforce prior to  seeking to apply to have your eligibility for right of abode verified after 7 years continuous ordinary residence?

QUESTION

Hello Visa Geeza,

Thanks so much for this!

I have just been terminated from my job but my visa does not expire until July 29th of next year – will I have an issue when it expires?

Will I need a visa extended to cover the application process/time after the 29th?

Also my employer submitted to the IRD that I am leaving Hong Kong (long story) but I am not. How does that work? Would my visa still be active?

Finally, how long can I be away from Hong Kong for in order to still maintain my eligibility for right of abode in Hong Kong once the years are up?

I got made redundant last week and plan on travelling for a couple of months.

During this time I would like to travel for about 2 months (Nov / Dec) and maybe take a course for two months (Jan / Feb) – do you think that is doable?

My visa expires the day it turns 7 years for me – July 29th 2016.

Sorry for the many questions!

Please advise.

Can I Easily Swap From a Working Holiday Visa to a Hong Kong Work Visa?

Posted by / in Employment Visas, Special Programmes, Your Question Answered / 1 response

How can one go about swapping from a Hong Kong Working Holiday Visa to a complete Hong Kong work visa?

SMALL-keep-calm-and-ask-the-visa-geeza

QUESTION

I am a British citizen with a 1st class degree, 2 years work experience and unique language abilities.

I am currently in Hong Kong on a working holiday visa and was employed at a specialist insurance company doing business development.

I have now been promoted to an account manager and thus I would like to know how one would go about applying for a normal work visa.

I understand cases like mine are rare but I have heard that it shouldn’t be a problem.

I thought I would ask you guys for a better opinion.

Will Redundancy & Subsequent, Extensive Overseas Travel Away Negatively Impact a Hong Kong Permanent Residency Application at the 7 Year Mark?

Posted by / in Employment Visas, Long Stay & PR, Your Question Answered / No responses

What are ImmD looking for to ensure that you are settled in Hong Kong at the time they consider your Hong Kong Permanent Residency application?

SMALL-keep-calm-and-ask-the-visa-geezaQUESTION

Firstly, thank you for the great service you provide. I just had two questions for you that are related.

I currently have a work visa for 3 years (2-2-3). In two years I want to make a Hong Kong permanent residency application as I will have lived here for 7 years. In 6 months I expect to lose my job (be made redundant). I understand I can continue to live here for the remainder of my work permit without working.

My first question is, will redundancy affect my Hong Kong permanent residency application in any way?

My second question is during the remaining 14 months while I am waiting to apply for the permanent residency I would like to spend most of it traveling in Asia and also the U.S. Will this affect my application for permanent residency in any way?

I plan to have an apartment and pay rent here during the entire time so I want to make sure I’m not wasting my money in doing so and that my Hong Kong permanent residency application will nevertheless go on to be approved.

Thank you again for the great service you provide.
