Should I Change My Hong Kong Visa Category From Sponsored Employment to Business Investment or Seek Permission to Join in a Side Business Instead?

Change my Hong Kong visa? This question is less either / or from an immigration perspective but more an issue of full time entrepreneur or not…

QUESTION

Hi Stephen,

I am currently already on an employment visa (valid for two more years) and would like to start my own company too.

My current employer is supportive.

 1) I understand I can’t work for my own company as of now and i need to submit a letter to ImmD.

Is it better that I submit a letter to ask permission to work for my own company (that I will setup) or should I go in for a transfer of sponsorship.

Are the processes of  ImmD significantly different for the two above – light versus heavy ?

The main benefit of a transfer of sponsorship will be to bring in my dependant wife next year after planned marriage (as compared to being exposed to getting fired at the current place).

2) In either of cases above, shall I be able to issue invoice and bill clients as soon as my company and payment system is setup?

Hong Kong Immigration Department Start e-Visa Arrangement (Online Application Process) From Today

Hong Kong Immigration Department Start e-Visa Arrangement  (implemented with effect from 28 December 2021)

PREPARATIONS FOR NEW E-VISA SYSTEM

  1. ImmD are NOT widely replacing offline case management protocols with Online e-Visa protocols for the foreseeable future
  2. This system applies for the next few months only to ASSG, Foreign Domestic Helpers and IANG (entry visas) and routine Extensions of Stay

E-VISA SYSTEM PROCESS SYNOPSIS

  1. Complete the application form online – you can keep the online application form open/saved for 14 days prior to formal submission to ImmD
  2. Upload supporting documents and submit to formally commence the application once ready to get started officially
  3. Once submitted the online application system can be used to communicate with ImmD, upload additional documents, enquire case status and manage approval formalities and pay.
  4. Upon approval, a payment notification slip will be issued which allows for payment online and offline (as usual)
  5. Upon payment, the e-Visa is downloaded in PDF format with a QR code (see samples enclosed)
  6. e-Visa is a collective term for the official visa PDF with QR code
  7. The QR code can be scanned via the ImmD mobile app to reveal the status of the e-Visa holder and/or the reference can be inputted into ImmD website for the same purpose

E-VISA ONLINE PAYMENT

  1. Visit GOV.HK website payment page
  2. Input application reference number
  3. Input applicant personal particulars
  4. Pay online
  5. Get acknowledgement receipt

RELEVANT FAQs ex-IMMD

Q1: What is an “e-Visa”?

A1: With effect from 28 December 2021, the Immigration Department (“ImmD”) has implemented the “e-Visa” arrangement. An applicant for an entry visa/permit, extension of stay or change of status, etc. will be issued with an “e-Visa”, such as a “Notification Slip for Entry Visa/Permit” or “Notification Slip for Conditions of Stay”, upon approval of the application and payment of the relevant fee (where applicable). “e-Visa” is a collective term for the relevant notification slips in a PDF file format. With the implementation of the “e-Visa” arrangement, the ImmD has ceased issuing sticker-type physical labels for entry visa/permit and extension of stay, etc.

Q2: What are the benefits of the “e-Visa” arrangement?

A2: With the implementation of the “e-Visa” arrangement, upon approval of the application, an applicant may pay online (where applicable), and instantly download or print the “e-Visa” by himself/herself without having to attend an Immigration Office in person for payment and collection of the “e-Visa”.

Q3: Is my current sticker-type physical label for an entry visa/permit or extension of stay, etc. still valid?

A3: The sticker-type physical labels for entry visa/permit and extension of stay, etc. issued before 28 December 2021 shall remain valid within the validity period or limit of stay as stated on the labels.

Q4: I currently hold a sticker-type physical label for an entry visa/permit or extension of stay, etc. issued before 28 December 2021, do I need to replace them with an “e-Visa”?

A4: No. The sticker-type physical labels for entry visa/permit and extension of stay, etc. issued before 28 December 2021 shall remain valid within the validity period or limit of stay as stated on the labels.

Q5: Do I need to carry an “e-Visa” printed on a sheet of A4 white paper with me or save its soft copy on a personal mobile device for inspection by authorised persons?

A5: An “e-Visa” holder should save his/her “e-Visa” in soft copy on a personal mobile device or print it on a sheet of A4 white paper for inspection when necessary.

Q6: Will I be issued with an “e-Visa” upon approval of my application submitted through Chinese Diplomatic and Consular Missions, or the Immigration Division of the Office of the Government of the Hong Kong Special Administrative Region in Beijing (Beijing Office) or the Immigration Division of the Hong Kong Economic and Trade Office in Shanghai (SHETO)?

A6: The “e-Visa” arrangement is not applicable to entry visa/permit issued by Chinese Diplomatic and Consular Missions, or the Immigration Divisions of the Beijing Office and the SHETO.

Q20: How do I go through immigration clearance after obtaining an “e-Visa”?

A20: Upon arrival clearance, an “e-Visa” holder should present his/her valid travel document, an exit endorsement issued by the relevant Mainland authorities (where applicable), and the “e-Visa” saved on a personal mobile device or printed on a sheet of A4 white paper, and scan the encrypted QR code on the “e-Visa” with the optical reader at an immigration counter.

Q21: With the ImmD’s implementation of the “e-Visa” arrangement, visitors and persons who have been granted permission to stay in Hong Kong no longer hold sticker-type physical labels for entry visa/permit or extension of stay, etc. How can the immigration authorities of other countries/regions know the “e-Visa” holders’ status in Hong Kong?

A21: Where necessary, travellers can print out the “e-Visa” or present its soft copy to the immigration authorities of their destinations to comply with the local immigration requirements.

Q25: How can I seek assistance if I encounter technical problems when paying online, or making enquiries about or downloading my “e-Visa”?

A25: Please call the technical support hotline operated by the contractor at (852) 3128 8668 from 7 am to 11 pm (Hong Kong time) daily.

Q26: Who should I contact if I have any other questions about the “e-Visa”?

QUESTION

Great website! I hope this reaches you well.

I’m writing on behalf of my partner, who has been in Hong Kong for over 6 years. He’s coming up to his 7th year of continuous residency, and he hopes to apply for the right of abode next year.

He has a great reputation at work, employed at a well known institution, and has always paid his taxes on time. He’s the perfect candidate for permanent residency, and has worked hard to get here.

The problem is that we recently had a bit of trouble with the police. It was a minor domestic issue, we had a fight that got out of control, and the police were called in. No charges were made, but there’s definitely a record of the incident in the police files.

It’s extremely regrettable, and after the dust settled I realized that this may have adverse effects on his future visa applications.

Do you think this jeopardizes his application?

Could he have his application denied because of this?

I’ve considered going to the police to explain the situation and ask to remove or at least mitigate the record, if possible.

Can I Quit My Job Just Before My 7 Year Anniversary to Work Overseas & Still Quality for PR in Hong Kong?

I have been continuously employed here for almost 7 years and will be eligible to apply for PR in Hong Kong this Sept.

If I leave my current job and start working for a different company outside of Hong Kong, is there any way I can still be eligible for PR in Hong Kong this September?

If the new company’s Hong Kong office hires me and then places me overseas as a temporary secondment, will it be OK to rent out the apt that I own when I go on the secondment?

If the new company’s Hong Kong office hires me and I take a month or two off in between jobs to travel before I start my new job, will this affect my PR application timing?

Hi,

There are two parts to my question:

I’m here on a Hong Kong work visa and have been here for 15 months now. My daughter will be turning 18 yrs old in August 2015.

She attends an International school full time; she will be 19 when she finishes there.

Q1 – Will I just renew my daughter’s Hong Kong dependant visa when I renew my employment visa and also my wife’s Hong Kong dependant visa in November later this year or will she have to go a different route?

Q2  – She is considering going to university in the UK. If she does this will she be classed as a dependent and her home in Hong Kong and be classed as a Hong Kong resident with a Hong Kong ID card and will this count towards getting her 7 years for PR eventually?

Do I Have to Terminate My Current Job if My Future Employer is Applying for My Hong Kong Work Visa Change of Sponsorship?

How do you handle the conundrum of keeping your old job whilst seeking permission of ImmD in regard to  your Hong Kong work visa change of sponsorship?

I hope you’re doing well. Do I have to terminate my current job if my future employer is applying for my Hong Kong work visa change of sponsorship?

I have received and signed an offer with my future employer and believe I have the qualifications and skills to give me a good chance at receiving a work visa.

However, for my future employer to start my work visa application I was asked to provide an employment reference letter confirming my termination date of my current employer.

This would mean I have to terminate my current job before the visa is granted for my new job.

Please let me know if you could help me out with my questions. Thanks for your time in advance.

How Can I Best Manage the Hong Kong Work Visa Implications of Changing Employers When I Have Just a Few Weeks Remaining On My Current Limit of Stay?

Hate your job and seeking a change? How is your Hong Kong work visa affected if it will be expiring soon?

I am working for a company and I really have had enough and want to change jobs.

The reasoning being is the work I signed up for is not the job I am doing now (too much travel plus I hate the role).

I have started interviews with other companies and I estimate it will take 2-3 months to find something else.

Another problem is because of the travel I need to undertake for my current employer makes it hard to confirm interviews dates and times as I have to travel at short notice.

My current Hong Kong work visa runs out in early November this year.

My main questions are:

(1) If I left my present employer now, what is an acceptable time frame to the Hong Kong Immigration Department to allow me to find another job?

(2) What are the processes I need to follow to stay within in the law and not end up with a black mark against my name?

(3) Also what happens if I have not found a role when my current Hong Kong work visa expires?

All other advice greatly received.
